Before you use HueNest
These terms explain HueNest Premium, automatic renewal, voluntary rewarded ads, exported-image watermarks, and the limits of local and installation-scoped progress recovery. Apple processes subscription payments, cancellation, and refund requests.
Agreement and provider
These Terms of Use apply to HueNest version 2.0 and later when those versions are made available. HueNest is offered by the developer identified on the App Store as 辉 郭 (the “Developer”). By downloading, accessing, or using HueNest, you agree to these Terms and the applicable Apple terms. If you do not agree, do not use HueNest.
If you are not legally able to enter this agreement where you live, a parent or legal guardian must review and accept these Terms as permitted by applicable law.
Relationship to Apple’s terms
These Terms supplement and do not replace, reduce, or conflict with the Apple Standard End User License Agreement or any mandatory minimum terms Apple requires for App Store apps. To the extent the Apple Standard EULA applies, it continues to apply. These Terms are not presented as a custom end-user license agreement replacing Apple’s Standard EULA.
Apple is not a party to these Terms between you and the Developer. The Developer, not Apple, is responsible for HueNest and its support, subject to the responsibilities Apple retains under its own terms and applicable law. Nothing in these Terms limits any rights Apple has as a third-party beneficiary where Apple’s applicable terms require them.
The HueNest service
HueNest provides a color-by-number experience, an online artwork library, local progress and completed-image features, and installation-scoped progress records. The authenticated installation can read its own records so HueNest can reconcile logical progress and History. If a same-device reinstall retains the original installation credential, HueNest may automatically recover backend-confirmed logical progress and History for that installation.
HueNest does not provide a user account or cross-device artwork-progress recovery. A new installation or another device cannot read the old installation’s records. Progress previews, completed images, exported images, downloaded artwork resources, Hint state, and watermark unlocks are not returned by the progress service.
A network connection is required to browse the live catalog and to confirm an artwork’s current version before starting or continuing it. If a connection is briefly interrupted after the canvas is open, HueNest keeps local checkpoints and may retry pending installation-scoped progress updates while that local data remains. This does not create an account or cross-device synchronization service.
HueNest Premium subscriptions
HueNest may offer auto-renewable weekly, monthly, and yearly subscriptions. All three periods provide the same Premium service: five base Hint uses per device-local calendar day, suppression of app-open, interstitial, banner, and comparable non-user-triggered ads while Premium is active, and watermark-free completed-image exports while Premium remains active. Premium does not unlock additional artwork and does not itself restore artwork progress.
The price, currency, period, and any introductory offer shown by HueNest or Apple are supplied for your App Store storefront. Current United States reference prices are $4.99 per week, $9.99 per month, and $49.99 per year; the price Apple shows before confirmation controls and may differ by storefront or change over time.
For a user Apple determines is eligible, the Weekly plan may begin with a three-day free trial. After the trial, it automatically renews at the standard weekly price shown by Apple unless canceled. Apple determines eligibility, and an Apple Account can generally use only one introductory offer within the HueNest Premium subscription group. Monthly and Yearly plans do not include an introductory offer or free trial.
Billing, renewal, plan changes, and cancellation
If Apple confirms an eligible free trial, the subscription fee is charged when the trial ends unless you cancel beforehand. For purchases without a trial, payment is charged to your Apple Account when you confirm the purchase. Each subscription renews automatically for the selected period unless canceled at least 24 hours before the end of the current period. Apple may charge the renewal price within 24 hours before that period ends.
You can manage or cancel HueNest Premium in your Apple Account subscription settings. Deleting HueNest does not cancel a subscription. Turning off renewal normally leaves Premium active until the already-paid period ends.
Weekly, Monthly, and Yearly provide the same service level. If you change between periods, Apple controls when the change takes effect. A change may take effect on the next renewal date rather than immediately. HueNest keeps the currently effective period separate from Apple’s verified renewal preference and does not promise an immediate period change or immediate additional charge.
Apple may require notice or consent before a subscription price change. If consent is required and not provided, the subscription may end at the close of the applicable paid period.
Restore Purchases, refunds, and entitlement changes
Restore Purchases asks Apple to synchronize an existing subscription and allows HueNest to verify the current Premium entitlement. It restores only the Apple subscription entitlement. It does not restore artwork progress, progress previews, completed images, rewarded Hint balances, downloads, or per-artwork watermark unlocks. Any eligible same-installation logical progress and History recovery is a separate automatic process and is not part of Restore Purchases.
Apple processes charges and refund requests. Refund eligibility and decisions follow Apple’s policies and applicable law. You can review a charge or request a refund through Apple’s Report a Problem. A refunded, revoked, or expired subscription may cause Premium benefits to end. If Apple confirms an active billing grace period, Premium may continue until that grace period ends; billing retry without an active grace period does not by itself extend Premium.
Hints and advertising
Free users receive two base Hint uses per device-local calendar day; active Premium users receive five. A successful Hint consumes one use. Unused base Hints and rewarded Hint balances do not carry into the next local calendar day.
When the available Hint balance reaches zero and a valid target exists, you may explicitly request a rewarded ad. A completed reward grants two additional Hint uses, and HueNest may immediately consume one to perform the Hint you requested. Closing, canceling, failing to complete, or not receiving a formal reward callback grants nothing and consumes no Hint. HueNest sets no daily product limit on these voluntary rewarded requests, but advertising availability is never guaranteed.
Free users may see app-open, interstitial, and banner ads only at HueNest’s defined lifecycle and page locations. Active Premium suppresses those and comparable passive ads. Premium users may still choose a rewarded ad when their Hint balance reaches zero because that request is user initiated.
Completed-image exports and watermarks
A completed image exported by a Free user includes a HueNest watermark in the lower-right corner unless that artwork version has already been unlocked. You may continue with the watermark or explicitly choose a rewarded ad to remove it for that specific artwork version in the current local installation data.
A confirmed watermark-removal reward remains effective for the same artwork ID and artwork version in that local data. It is not restored after HueNest is deleted or reinstalled, Application Support is cleared, or you move to another device. Even if a same-device reinstall reuses an installation credential stored in Keychain, it does not restore the local watermark-unlock record.
Active Premium exports without a watermark, but Premium alone does not create a permanent per-artwork unlock. If Premium ends, an artwork version that was not separately unlocked through a rewarded ad returns to the Free watermark behavior. A version previously unlocked through a confirmed rewarded ad remains unlocked while that local unlock record exists.
Local progress, Delete, and Restart
HueNest stores logical progress, previews, completed images, and downloaded artwork locally. Delete removes the selected artwork’s local progress, History state, and derived previews and submits a deletion marker for that installation and artwork. Downloaded artwork resources remain on the device. Restart replaces the current progress with a new zero-percent revision; the earlier progress is not retained as a user-accessible version. Both actions require confirmation in the app.
Acceptable use
You may use HueNest for personal, non-commercial enjoyment. You may not interfere with the service, bypass security or purchase controls, automate abusive requests, extract or redistribute protected artwork packages, manipulate advertising rewards, introduce malicious code, or use HueNest in violation of applicable law or another person’s rights.
License and intellectual property
HueNest, its software, branding, and supplied artwork are protected by intellectual-property laws. Subject to Apple’s applicable license terms, you receive a limited, personal, non-transferable right to use HueNest and to save or share images through the features provided. No other rights are transferred. Rights in third-party content remain with their respective owners.
Third-party services
HueNest relies on Apple services, hosting and content-delivery providers, and advertising and consent providers. Their availability and separate terms may affect purchases, downloads, advertising, or other network features. Review the Privacy Policy for the relevant data-processing categories.
Availability, updates, and termination
The Developer may maintain, update, suspend, or discontinue features when reasonably needed for security, legal compliance, service reliability, provider changes, or product development. Artwork and network features are not guaranteed to be continuously available. An already-paid Premium period will not be intentionally reduced except as required by Apple, applicable law, a refund or revocation, or action needed to prevent abuse or harm.
Disclaimers and limitation of liability
To the extent permitted by applicable law, HueNest is provided “as is” and “as available,” without a promise that it will always be uninterrupted, error-free, or compatible with every network or device condition. Nothing in these Terms excludes warranties, remedies, or liabilities that cannot lawfully be excluded or limited.
To the extent permitted by applicable law, the Developer is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of HueNest. Any limit applies only to the extent the law permits it and does not reduce mandatory consumer rights.
Governing law and disputes
To the extent a choice of law is permitted, these Terms are governed by the laws of the People’s Republic of China as applied in Mainland China. This choice does not deprive you of mandatory or non-waivable consumer rights, protections, or remedies under the law of your habitual residence or any other law that applies regardless of this choice.
You may voluntarily contact the Developer before starting formal proceedings to try to resolve a dispute. Doing so is not required and does not limit any right, remedy, or applicable filing or limitation period. Either party may bring a claim in any court or other forum that has jurisdiction under applicable law. These Terms do not require a consumer to bring a claim in any specific court and do not limit any non-waivable forum, procedure, or remedy.
General terms
If any provision is found unenforceable, it will be limited to the minimum extent necessary and the remaining provisions continue to apply. A failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, and the applicable Apple terms form the relevant agreement for the matters they cover.
Changes to these Terms
These Terms may be updated when HueNest, legal requirements, or service providers change. The revised Terms will be posted here with a new effective date. If a material change requires additional notice or consent, it will be provided as required by applicable law.
